Online Store Terms and Conditions Remake Up Academy
1. Scope and Purpose of the General Store Conditions
These General Conditions, together with the order form and any other elements referred to therein, are intended to govern the terms and conditions under which the provision of the Remake Up Online Store Service will be conducted by Remake Up Academy, located at 410 Sauchiehall Street, G2 3JD, Glasgow - UK, email info@remakeupacademy.com, hereinafter referred to as “Remake Up Academy”.
The Service consists of providing access via the address [https://remakeupacademy.com](https://remakeupacademy.com) to the Online Store which, in addition to providing information relative to a set of products and/or services, enables the User, via electronic means, to order the products displayed therein, under the terms and conditions described herein.
Product orders must be placed by Users aged 18 (eighteen) or over (individuals under this age must have authorization from their legal representatives). The elements and information transmitted by the User shall enjoy full legal effect, with the User recognizing electronic acquisitions and being barred from alleging a lack of signature for the non-fulfillment of assumed obligations.
2. Product Information and Content
Remake Up Academy will make every possible effort to ensure that the information presented does not contain typographical errors, and these will be promptly corrected whenever they occur. If you acquire a product that has different characteristics from those presented online, you have the right to proceed with the cancellation of the purchase contract under the applicable legal terms (right of free withdrawal – see point 9).
Remake Up Academy will make every possible effort to dispatch all ordered products, but it is possible that, in certain cases and due to causes difficult for Remake Up Academy to control—such as human errors or incidents in computer systems—it may not be possible to provide some of the products requested by the User. If any product is unavailable after an order has been placed, you will be notified via email or telephone. At that moment, you will be given the option to cancel the order with a full refund, should payment have already been made.
All information regarding price, products, specifications, promotional campaigns, and services may be altered at any time by Remake Up Academy.
3. Responsibilities
3.1 All products and services commercialized in the Remake Up Academy Online Store comply with applicable UK consumer and commercial laws.
3.2 The Store possesses adequate security levels; however, Remake Up Academy shall not be liable for any damages suffered by the User and/or third parties resulting from delays, interruptions, errors, and suspensions of communications originating from factors beyond its control, namely any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, modems, connection software, or eventual computer viruses, or resulting from downloading files infected with or containing viruses or other properties that may affect the User's equipment. If, for any reason involving an access error to the Remake Up Academy Online Store website, there is an impossibility to provide the service, Remake Up Academy shall not be liable for any eventual losses.
3.3 Data and information consultations performed under the scope of this Service are presumed to be performed by the User, with Remake Up Academy declining any responsibility arising from the abusive or fraudulent use of the information obtained.
3.4 Remake Up Academy shall not be liable for any losses or damages caused by abusive uses of the Service that are not directly attributable to it by way of willful misconduct or gross negligence.
3.5 Remake Up Academy is not responsible for losses or damages resulting from non-compliance or defective compliance with the Service when this is not directly or indirectly attributable to it by way of willful misconduct or gross negligence, not being responsible namely for (i) errors, omissions, or other inaccuracies regarding information made available through the Service; (ii) damages caused by the fault of the User or third parties, including intellectual property violations; (iii) non-compliance or defective compliance resulting from compliance with judicial decisions or administrative authorities; or (iv) non-compliance or defective compliance resulting from the occurrence of force majeure situations, i.e., situations of an extraordinary or unpredictable nature, external to Remake Up Academy and beyond its control, such as fires, power outages, explosions, wars, riots, civil insurrections, governmental decisions, strikes, earthquakes, floods, or other natural cataclysms, or other uncontrollable situations that prevent or hinder the fulfillment of assumed obligations.
3.6 Remake Up Academy does not guarantee that:
i) The Service will be supplied uninterruptedly, securely, error-free, or function infinitely;
ii) The quality of any product, service, information, or other material purchased or obtained through the Service will meet any expectations of the User regarding the same;
iii) Any material obtained in any way through the use of the Service is used at the User's own risk, the User being solely responsible for any damage caused to their computer system and equipment or for any data loss resulting from that operation;
iv) No advice or information, whether oral or written, obtained by the User from or through the Service shall create any warranty not expressly stated in these General Conditions.
3.7. The User accepts that Remake Up Academy cannot under any circumstances be held liable for any damages, including, but not limited to, damages for loss of profits, data, content, or any other losses (even if the User has been previously advised of the possibility of the occurrence of such damages) resulting from:
i) The use or impossibility of using the Service;
ii) The difficulty in obtaining any substitute goods/services;
iii) Unauthorized access to or modification of personal databases.
4. Consumer Obligations
4.1 The user undertakes to:
i) Provide correct personal data and addresses;
ii) Not use false identities;
iii) Respect the imposed order limits.
4.2 If any data is incorrect or insufficient, causing a delay or impossibility in processing the order or eventual non-delivery, the responsibility lies with the User, and Remake Up Academy declines any liability. If the consumer breaches any of these obligations, Remake Up Academy reserves the right to eliminate future purchases, block access to the store, cancel the supply of any other services simultaneously made available by Remake Up Academy to the same User, and prohibit the User's future access to any or all services provided by Remake Up Academy.
4.3 It is expressly forbidden to use the acquired products and services for commercial purposes, namely for the resale of goods.
5. Privacy and Personal Data Protection
5.1 Remake Up Academy guarantees the confidentiality of all data provided by Users.
5.2 The personal data identified on the order form as mandatory are indispensable for the provision of the Service by Remake Up Academy. The omission or inaccuracy of data provided by the User is solely and entirely their responsibility and may result in Remake Up Academy refusing to provide the Service.
5.3 Personal data provided by the User will be processed and stored electronically by Remake Up Academy, expressly intended for:
a) Management of the contractual relationship, processing, invoicing, and dispatch of orders;
b) Creation and management of the client file for history, tracking, and continuous provision of services and associated aesthetic treatments;
c) Marketing communications, promotional campaigns, and newsletter distribution, provided the User has given prior, explicit, and unequivocal consent for this purpose.
5.4 Under applicable legislation (including the UK GDPR and Data Protection Act 2018), the User is guaranteed the right of access, rectification, erasure, restriction of processing, data portability, and objection to the processing of their personal data, as well as the revocation of marketing consent at any time. 5.5 The Internet is an open network, meaning the User's personal data, other personal information, and all content hosted on the Service may circulate across the network without security conditions, running the risk of being accessible and used by unauthorized third parties, and Remake Up Academy cannot be held liable for such access and/or use.
6. Order Cancellation
6.1 At the User's request
The User may cancel their order by requesting it from Remake Up Academy via telephone or email, mentioning the order number. This will be accepted as long as the order has not yet been processed. Once processed, Remake Up Academy will attempt to deliver it, but the User has the option to refuse acceptance.
For cancellation purposes, the User must provide the following details to Remake Up Academy:
a) Order number
b) Tax ID (or equivalent identification number) used for the order and delivery address
6.2 By decision of Remake Up Academy
Remake Up Academy reserves the right not to process orders when inconsistencies in the presented personal data are verified or misconduct by the buyer is observed. Remake Up Academy reserves the right not to process any order or refund in the event of errors in prices and/or product characteristics arising from technical problems or errors beyond Remake Up Academy's control.
7. Returns (Right of Withdrawal)
7.1 If the User is a consumer, they may exercise the right of withdrawal without penalty, within 14 (fourteen) days from the day the consumer acquires physical possession of the goods.
To exercise this right, the User may use the template indicated below, stating all identification details, the subscribed service they wish to withdraw from, and the subscription date. Communication must be made by letter, by returning the acquired good, or via another suitable and provable medium within the aforementioned timeframe.
The consumer must return the goods to Remake Up Academy in proper condition for use within 14 (fourteen) days from the date of the withdrawal communication.

The packaging must be returned complete, exactly as delivered, and accompanied by all received documentation, namely: sales invoice and the document proving receipt of the product. The packaging and indicated documents must be sent free of charge to the following address:

If the User opts for other return methods, the respective shipping costs shall be their responsibility.
7.2 Upon receipt of the return at Remake Up Academy, the amount paid for the order (sales invoice value) will be refunded to the User. If a promotional discount code was used, that value will not be refunded; i.e., the refund will only cover the amount effectively paid.
7.3 The refund method depends on the payment method used for the respective order. Credit card and PayPal payments are credited back to the respective accounts. In other cases, when bank account details (IBAN/Sort Code) are provided, the refund is made to the indicated bank account. Otherwise, the refund is issued via cheque to the billing address. Refunds are processed up to 14 days after receipt of the notice of free withdrawal and receipt of the returned goods.
7.4 In the absence of any component of the sold item or if any component is not in excellent condition, no refund of the price or shipping costs will take place, and the product will be shipped back to the initial dispatch address.
8. Manufacturing Defects
8.1 In case of a "manufacturing defect"—meaning when equipment malfunctions are detected that do not fall under the scope of the respective warranty—the User must return the equipment, along with a copy of the invoice and the completed "Equipment Exchange/Return Request" form, within a maximum period of 30 consecutive days from the invoice date, to the following address:

If the User opts for other return methods, the respective shipping costs shall be their responsibility.
8.2 For the product exchange to take place, you must ensure that the packaging is complete (box, instruction manual, warranty certificate, terminal, and accessories) containing all constituent components in excellent condition.
8.3 In the absence of any of the aforementioned elements, or if any component is not in excellent condition, no exchange will take place, and the product will be shipped back to the User.
9. Warranty
9.1 All equipment available in the Store is duly certified by competent international entities.
9.2 Equipment and accessories carry a warranty period defined by the manufacturer, which under legal terms is a minimum of 2 (two) years. This period is considered from the equipment invoice date and can only be exercised upon presentation of the warranty certificate and/or proof of purchase (invoice) duly completed.
9.3 Equipment that has exceeded the manufacturer's defined period or presents defects caused by abnormal wear and tear, improper installation, severe weather, electrical surges, negligence or accidents, mishandling, moisture/liquid infiltration, use of non-original accessories, and technical interventions by unauthorized personnel are considered outside warranty conditions.
9.4 If the equipment malfunctions and is covered by the warranty, the User may take it, along with the respective proof of purchase and/or warranty, to a brand technical assistance center.
9.5 Accessories covered by the warranty that malfunction must be sent, along with the respective proof of purchase and/or warranty, to the following address:

If the User opts for other return methods, the respective shipping costs shall be their responsibility. The User must always request proof of dispatch.
9.6 If the equipment malfunctions and the malfunction is not covered by the warranty, the User may take it, along with proof of purchase, to a brand technical assistance center.
10. Intellectual Property
10.1 The Store is a registered website and the Service provided by the site itself is the responsibility of Remake Up Academy.
10.2 The User recognizes that the Service contains confidential information and is protected by copyright and related rights, industrial property, and other applicable legislation.
10.3 The User recognizes that any content appearing in advertising, highlights, promotions, or mentions of any sponsor or advertiser is protected by laws relating to copyright and related rights, industrial property laws, and other property protection laws, and any use of such content may only occur under express authorization from the respective holders.
10.4 The User undertakes to fully respect the rights referred to in the previous number, specifically abstaining from practicing any acts that may violate the law or said rights, such as reproduction, commercialization, transmission, or making available to the public of such contents, or any other unauthorized acts targeting the same contents.
11. Service Security Conditions
11.1 The User undertakes to observe all applicable legal provisions, namely not to practice or encourage the practice of illicit acts or offenses against good morals, such as the indiscriminate sending of unsolicited communications (spamming) in violation of legislation applicable to personal data processing and advertising communications via automatic calling devices, and must also observe the rules of use of the Service, under penalty of Remake Up Academy suspending or deactivating the Service under the terms provided in point 14.
11.2 The User expressly recognizes and accepts that the IP Network constitutes a public electronic communications network susceptible to use by multiple users and, as such, subject to computer overloads, meaning Remake Up Academy does not guarantee the provision of the Service without interruptions, information loss, or delays.
11.3 Remake Up Academy likewise does not guarantee the provision of the Service in situations of unpredictable overload of the systems supporting it or of force majeure (situations of an extraordinary or unpredictable nature, external to Remake Up Academy and beyond its control).
11.4 In the event of an interruption in the provision of the Service due to reasons of unpredictable overload of the supporting systems, Remake Up Academy undertakes to regularize its operation as quickly as possible.
12. Suspension and Deactivation of the Store Service
12.1 Regardless of any prior or subsequent communication, Remake Up Academy may, at any time and according to its exclusive discretion, discontinue the provision of the Service and/or part of the Service to one or all Users.
12.2 Remake Up Academy further reserves the right to suspend or immediately terminate access to the Service in the following cases:
a) When the User does not observe the terms of use referred to in point 4 and others referred to in the General Conditions;
b) When Remake Up Academy ceases access to the Store, by means of prior notice 15 days in advance of the cessation date.
12.3 The suspension or cessation of the Service by Remake Up Academy under the previous numbers does not entail the right of the User or third parties to any indemnity or other compensation, and Remake Up Academy cannot be held liable or burdened in any way for any consequence resulting from the suspension, annulment, or cancellation of the Service.
12.4 In the situations described above, Remake Up Academy will communicate with the User in advance so that the User may, if desired, safeguard the content of their order viewing area within 3 (three) working days from the sending of the email or making the information available on the main page of the Service.
13. Communications
13.1 Without prejudice to other forms of communication provided for in these General Conditions, notifications made to the User related to the Service, including eventual changes to these General Conditions, may be made to the User's email address, by SMS, or telephone contact.
13.2 The User accepts to receive any and all communication and/or notification related to the Online Store at the address, contact telephone number, and/or email address indicated in the order process.
At any time, you may request not to receive these communications and/or notifications through the Contact Form or via the "Unsubscribe from Newsletter" option included in each Newsletter.
14. Technical Configurations
14.1 Without prejudice to the provisions of the following number, Remake Up Academy may alter the Service and/or its technical provision conditions, as well as its usage rules, and must disclose such changes to the User at least 15 (fifteen) days in advance.

15. Optimization and Upgrades
15.1 Whenever Remake Up Academy deems it necessary or convenient to optimize the browsing experience and/or improve connectivity conditions, it may remotely reformulate network configurations.
15.2 Without prejudice to the provisions of the following numbers, and given the innovative character of the Service and technological developments to which it may be subject, Remake Up Academy may alter its technical configurations whenever this proves convenient to adapt it to eventual technological developments.
15.3 Remake Up Academy does not, however, guarantee the User the realization of any upgrades or improvements in the Service.
15.4 Some upgrades or new functionalities of the Service may be available only against payment by the User and/or subscription to Specific Conditions of Use.
16. Complaints
16.1 The User may submit any contractual conflicts to arbitration and mediation mechanisms that are or may be legally established, as well as complain to Remake Up Academy regarding acts and omissions that violate legal provisions applicable to the acquisition of goods.
16.2 The complaint must be presented within a maximum period of 30 (thirty) days, counted from the knowledge of the facts by the User, and will be registered in Remake Up Academy's information systems, which must decide on the complaint and notify the interested party within a maximum period of 30 (thirty) days from the date of its receipt.
17. Applicable Law
This Contract is governed by the laws of Scotland and the United Kingdom.
